The judicial system is based on a composite of English common law, Koranic law, and customary law. It accepts compulsory ICJ jurisdiction with reservations, and includes subsidiary legislative instruments enacted locally. The constitution provides for an independent judiciary, and although the courts are not totally free from influence of the executive branch, they have demonstrated their independence on occasion.

The Supreme Court, presided over by a Chief Justice, has both civil and criminal jurisdiction. Formerly, appeals from any decision of the Supreme Court went before the Court of Appeals, whose judgments could be taken to the UK Privy Council. The January 1997 constitution provided for a reconfiguration of the courts with the Supreme Court replacing the Privy Council.

Muslim courts apply Shari'ah law in certain cases involving Muslim citizens, and in traditional matters, Chiefs rule on customary law and local affairs. District tribunals serve as appeals courts in cases of tribal law and custom. Cases of first instance in criminal and civil matters are handled by administrative officers who function as magistrates in courts located in each of the five administrative regions and Banjul.

The mission of the Judiciary of The Gambia is to advance the course of justice and the rule of law by ensuring a free fair and speedy dispensation of justice by an efficient independent judiciary with a high quality human resource base that will command the support and confidence of the people.

The Judiciary is mandated with:

* Administration and Delivery of Justice and
* Exercise of the judicial power of the State.

Its core functions are:

* Adjudication of disputes through the due process of Law,
* Administration of courts, registries, processes, directives & procedures
* Enforcement of decisions, orders, rulings and judgments

Impact of Results
The assignment will result in the establishment and operationalisation of a comprehensive monitoring and planning system for the Judiciary of The Gambia, thereby ensuring greater efficiency in the administration of justice.

Duties and Responsibilities

* The development and implementation of sound M & E mechanisms for the Judiciary and providing the necessary technical support/advise to the Judiciary in the design and implementation of their activity plans.
* Work with key persons in the judiciary to formulate the mandate and functions of the Monitoring and Planning Unit.
* Under the directions of the Chief Justice, work closely with Judiciary’s constituent units to develop M & E approaches, conceptual models and M & E designs including the development of data analysis plans and M & E systems at national and regional.
* Work with the Office of the Chief Justice in assisting relevant units to interpret and present data (where appropriate in concise and simple formats) for decision making and improved programmes’ design and implementation.
* Coordinate periodic project/programme performance reporting within the Judiciary and be responsible for the compilation of such reports, their dissemination and presentations in multiple fora e.g. Judiciary’s website, meetings, conferences, media programmes, etc.
* Responsible for the preparation of Monitoring and Evaluation activities for inclusion in the annual budget.
* Responsible for the preparation of activity reports for inclusion in the annual report of the Judiciary
* Train national counterparts on all duties performed

Functional Competencies

General Professional experience required

* The successful candidate should have considerable experience in the planning and monitoring field particularly in the development of monitoring and planning mechanisms.

Specific professional experience required

* Ability to interpret/analyze complex, scientific and conceptual data (qualitative and quantitative) and produce concise, simple and understandable information for purposes of policy makers and non-scientific audiences.
* Advanced scientific/mathematical modeling knowledge for dealing with situations where complete/current data are not available for appropriate analysis to inform decision and policy makers.
* Ability to manage a team of monitoring and evaluation staff and to coach less experienced team members.
* Technical knowledge: Knowledge of Specialized Date processing/analysis software SPSS, Access, Database.
* Proven ability to design and conduct monitoring and evaluation of programmers, particularly judicial system monitoring

Required Skills and Experience

* Masters degree with at least 5 years research experiences or a Bachelors degree with 7 years research experiences in a Social Science or Development field
